$2.75 million settlement for South Mountain developer

(Draper Journal) Draper City will receive 109 acres of open space and South Mountain LLC will receive $2.75 million in Salt Lake County open space funds plus 7.5 acres of city-owned property, according to a recent settlement agreement.

The action settles a lawsuit filed against the city in 2005 in which South Mountain LLC complained that city officials weren’t allowing them to exercise development rights given to the company in a 1999 agreement.

After signing the 1999 agreement, Draper city officials found that some of the areas to be developed were on the site of an ancient landslide and were considered geologically hazardous. The developer disagreed and sued.

As part of the settlement, South Mountain LLC will receive 7.5 acres of city-owned land near Vestry Road and Bangerter Parkway and be permitted to build up to 79 condominium units on the property.
